Addressing Insolvency-Specific eDiscovery Challenges

This engagement directly addressed three common pain points faced by insolvency practitioners, liquidators, and law firms handling insolvency litigation:

1. Consolidating Large Data Sets for Insolvency Investigations

Law In Order hosted approximately two million documents in a secure Repository Workspace for Early Case Assessment (ECA). Using keyword searches and advanced analytics – including concept clustering, email threading, near-duplicate detection, and targeted keyword strategies – enabled the set of documents requiring review to be reduced by 90%.

This triage enabled rapid isolation of materials relevant to insolvent trading, voidable transactions (e.g. unfair preferences, unreasonable director-related transactions), related party dealings, asset disposals, and solvency indicators.

Without these tools, insolvency firms risk overwhelming review burdens and missing critical evidence in corporate restructuring and liquidation proceedings.

2. Prioritising Review of Relevant Documents

Law In Order deployed Technology Assisted Review (TAR), specifically a Prioritised Review model, to streamline document prioritisation and further reduce review volumes. This fusion of AI-driven ranking with expert legal judgment quickly surfaced:

  • anomalous transactions;
  • payment patterns within the relation back period;
  • related party communications; and
  • other signals relevant to recovery actions, statutory reporting and director liability assessments.

3. Producing Defensible Review Records

Law In Order aligned issue tags and coding frameworks to insolvency-specific questions such as:

  • director knowledge of insolvency,
  • safe harbour documentation,
  • relation back period payments,
  • PPSR and security interests,
  • intercompany loans, and
  • communications with critical suppliers.

Coding calibration sessions ensured consistent treatment of privilege, confidentiality, and issue relevance, producing a defensible review record suitable for court proceedings, regulator scrutiny, and public examinations.

Outcome-Driven Deliverables for Insolvency Matters

Working closely with the client and external counsel, Law In Order followed a structured process spanning matter scoping, briefing, coding calibration, review management, quality assurance, data release, and post-project debriefing.
